摘  要：凭证价值是电子档案的基本价值，而我国现行《刑法》中的档案犯罪主要保护的是国家的档案管理秩序而非档案的凭证价值。这种单一的立法价值选择已经不能满足保护电子档案凭证价值的现实需要。刑法是电子档案凭证价值法益的最后保障，应当紧密与新《档案法》衔接，通过电子档案凭证价值保护法益的专门化、罪名设置的类型化和凭证价值法益的可测量化等技术手段，建立健全电子档案凭证价值的刑法保护机制。

Abstract： Evidence value is the basic value of electronic Archives， and the archival crime in my country's current 'Criminal Law' mainly protects the national Archives management order rather than the evidence value of Archives. This one-sided choice of legislative value can no longer meet the actual needs of protecting the value of electronic Archives. Criminal law is the final guarantee for the value of electronic Archives and the legal benefits of evidence. It should be closely integrated with the new 'Archives Law'. It should be established through technical means such as the specialization of the value of electronic Archives to protect the legal benefits， the typification of criminal charges， and the measurability of the value of evidence. Improve the criminal law protection mechanism for the value of electronic Archives.

新修订的《档案法》（以下称新《档案法》）以法律形式确认了电子档案的凭证价值，规定电子档案在“来源可靠、程序规范、要素合规”的前提下，可以以电子形式作为凭证使用。新《档案法》和档案规范性文件中都十分重视对电子档案凭证价值的保护，但是作为电子档案凭证价值最后保障的《刑法》，似乎更注重对国家档案管理秩序的保护，对档案的凭证价值缺少应有的关注，成为电子档案凭证价值保护的薄弱环节之一，而学者们对上述问题亦鲜有涉猎。因此，探寻电子档案凭证价值的刑法保护机制，迫在眉睫。

1 电子档案凭证价值及其法律转化
