摘 要： 网络舆情监督作为一种“权利对权力”的监督模式，正深入影响着检察权的运作。一方面，网民朴素的道德情感和参与司法的热情，客观上助推了检察机关执法效果的有机统一；网络舆情所形成的强大舆论压力，也成为检察机关提高执法公信力的一种“倒逼机制”。另一方面，由于网络舆情监督与检察监督在价值取向方面存在差异，导致网络环境的“司法广场化”与检察机关“司法理性”之间、网络舆情演绎的“民意审判”与检察权依法独立行使之间、网络舆情片面追求实体正义与检察机关恪守正当程序理念之间，存在着冲突和矛盾。为此，应从规范网络舆情监督检察工作的界限、网络舆情监督下的检察官角色定位、健全确保检察权依法独立行使的外部监督制约机制以及构建一种回应型的检察权运行机制等方面，努力协调二者之间的矛盾，实现网络舆情监督与检察监督的良性互动。

The Procuratorial Supervision Based on Network Public Opinion： Conflict and Optimization

Abstract： Network public opinion supervision as a “right to the supervision of power” model， deeply affects the operation of the procuratorial authority. On the one hand， the netizens simple moral feelings and the enthusiasm of participatation in judicial， objectively have helped organic unity of prosecutors law enforcement effect； Strong pressure of public opinion has become a forced mechanism by improving law enforcement credibility of procuratorial organ. On the other hand， due to the differences between network public opinion supervision and the value orientation of procuratorial supervision， the conflict and contradictory exist the following cases： the judicial publicity of network environment and judicial rationality of the procuratorial organs； public trial caused by network public opinion and independent authority of procuratorate； substantive justice pursued by he network public opinion and the concept of due process abode by procuratorial organs. Therefore， we should standardize the boundaries of the network public opinion supervision and procuratorial work， and form the prosecutors role under the network public opinion supervision， in order to perfect the restriction mechanism to ensure procuratorial authority independently according to law and external supervision as well as operation mechanism to respond to the prosecutorial power， etc. To coordinate the contradiction， we nay realize the interaction of network public opinion supervision and procuratorial supervision.
