摘要：体育法律法规文化的发展对体育法律治理体系的有效运行具有重要意义。采用文献资料、逻辑分析等研究方法，从体育法律法规文化的结构内核、发展模式及传播途径对体育法律法规文化发展进行了理论探索。研究认为：体育法律法规文化在结构判断上应立足于实践操作层面和思维引领层面两个视角;从体育权的角度出发，确定体育法律法规文化的内核应为体育的法制意识;体育法律法规文化的发展模式可以选择“政府主导型”发展模式和“非政府主导型”发展模式;影响体育法律法规文化传播的主要因素是社会因素和传播的受众，在途径上则可以采取直接传播途径和媒介传播途径。《体育法》在修订阶段，要重视体育法律文化的特殊价值，把握其主要特征，并实践于法律法规调整，可有效提升体育法律体系的治理能力与治理水平。

The Development of Sports Laws and Regulations Culture in China：Structural Core， Mode and Transmission Way

Abstract：The development of sports laws and regulations culture is of great significance to the effective operation of sports legal governance system. By using the methods of literature review and logical analysis， this paper makes a theoretical exploration on the development of sports laws and regulations culture from the perspective of its structural core， development mode and communication channels. The results show that： the structure judgment of sports laws and regulations culture should be based on two perspectives of practical operation and thinking guidance; From the perspective of sports right， the core of sports law culture should be sports legal consciousness; The development mode of sports laws and regulations culture can choose “government led” development mode and “non-government led” development mode; The main factors that affect the cultural communication of sports laws and regulations are social factors and the audience. In terms of the way， we can adopt direct communication and media communication. In the revision stage of sports law， we should pay attention to the special value of sports legal culture， grasp its main characteristics， and practice in the adjustment of laws and regulations， which can effectively improve the governance ability and governance level of sports legal system.

隨着体育强国建设战略目标的启动实施，国家对新发展阶段的体育法治建设提出了新的要求。党的十九届五中全会提出基本建成法治国家、法治政府、法治社会的愿景也需要包括体育法律体系在内的各法律部门协同并进。但事实上，体育法律法规作为支撑和保障国家体育事业发展的重要指南，在全民健身、竞技体育、特殊人群体育、体育产业、反兴奋剂和体育纠纷解决等问题中屡遭践踏、部分领域纯粹依靠政策调整，法律缺位现象严重[1]，究其原因体育法律法规文化的缺失不可回避。……
