摘要：环境污染责任保险（以下简称“环责险”）是新修订实施的环境保护法亮点之一，也是生态文明建设中防范企业环境风险的重要措施，具有典型的生态文明建设时代内涵。我国环责险，从探索到试点，再到立法和制度完善，经历了针对性较强、发展周期较长的过程。根据国内试点实施情况，环责险发挥了相应的积极作用，然而在进一步推广实施过程中还面临着一些实际困难。为更好贯彻生态文明建设总体要求，促进环境保护法关于环境污染责任保险法条的实施，从完善法理基础、顶层制度设计、绿色金融体系建设、配套支持保障、引导企业树立正确观念等角度分析研究，提出推动环境污染责任保险实施的相关对策建议。

Research on promoting and implementing of environmental pollution liability insurance from the perspective of ecological civilization

Abstract：Environmental pollution liability insurance is one of the highlights of the newly revised implementation of the Environmental Protection Law of the People's Republic of China. It is also an important measure to prevent corporate environmental risks in the construction of ecological civilization. It has the typical connotation of the era of ecological civilization construction. China's environmental pollution liability insurance， from exploration to pilot， to the legislation and system improvement， has experienced a process that is highly targeted and longer development cycle. According to the domestic pilot implementation， environmental pollution liability insurance has played a corresponding positive role， but is facing some practical difficulties in the process of further promotion and implementation. In order to better implement the general requirements for ecological civilization construction and promote the implementation of the Environmental Protection Law on environmental pollution liability insurance laws， from the perspective of improving the legal basis， top-level system design， green financial system construction， supporting policies guarantee， and guiding enterprises to establish correct concepts， etc.， to analyze and research， so the relevant countermeasures and suggestions to promote the implementation of environmental pollution liability insurance were put forward.

黨的十八大将生态文明建设纳入“五位一体”中国特色社会主义事业总体布局，要求“把生态文明建设放在突出地位，融入经济建设、政治建设、文化建设、社会建设各方面和全过程”，生态文明建设不仅要发挥重要的成员功能，还要与其他“四大建设”融为一体，共同发展[1]。在此背景下，新环境保护法修订实施，同时将环境污染责任保险写入新法，成为亮点之一，引起积极关注。把握环境污染责任保险在生态文明建设中的重要引领示范作用，剖析其实施过程中存在的突出问题和面临的困境，研究提出相关对策和建议，对充分运用好环境污染责任保险的特殊作用机制，大力推进生态文明建设，建设美丽中国，具有十分重要的理论意义和现实意义。……
