摘  要：隨着我国经济的快速发展，电子商务迅速崛起，跨境贸易日益增多。与此相对应，我国物流行业也取得了长足的进步，逐渐向全球化发展。在物流行业高速发展态势下，我国对于物流行业的法律保障却并不完善，存在着一系列问题。主要体现在现有法律规范之间缺乏协调性，内容相冲突，以及现有物流立法较为滞后，立法层次较低，内容较为片面，没有一部综合性的法律法规对物流行业予以法律保障。在全面依法治国的今天，发现并解决当前我国物流行业法律制度所存在的问题，并予以解决，对于物流行业的稳定发展具有重要意义。

Abstract： With the rapid development of China's economy， the rapid rise of e-commerce， cross-border trade is increasing. Corresponding to this， China's logistics industry has also made considerable progress， gradually to the development of globalization. With the rapid development of logistics industry， the legal guarantee of logistics industry in China is not perfect， and there are a series of problems. This is mainly reflected in the lack of coordination between existing laws and regulations， conflicts of contents， lagging behind of existing logistics legislation， low level of legislation， relatively one-sided content， and lack of comprehensive laws and regulations to provide legal protection for the logistics industry. It is of great significance for the stable development of the logistics industry to discover and solve the problems existing in the current legal system of the logistics industry in our country.

随着经济社会的快速发展，互联网技术日益成熟。网络交易平台也随之兴起，网络购物日益成为普通民众的主要购物选择。与此相伴随，物流需求也日益增大，我国物流行业也随之急剧发展，体系日益完善，成为国内经济发展的重要支柱性产业。当今的物流行业已不再是单一的物流运输，而是包括了仓储业、运输业、信息业等多元化的服务性产业[1]。物流行业已经成为了我国经济社会发展不可或缺的部分，必须要有健全的法律制度为其稳健发展提供法制保障。鉴于此，在当前物流业快速发展的今天，构建一个体系健全、内容完善的物流法律体系已经成为我国物流行业发展中亟待解决的问题。
