摘  要：档案馆所承载的社会职能和应有的社会形象决定了其不宜过多地陷入与他人的诉讼纷争之中。目前我国涉档案馆诉讼案件呈现出逐年递增、案件分布较广和主要以被告身份出庭等特征。基于档案馆自身维度，该类案件发生的缘由主要在于：对诉前矛盾纠纷的化解重视程度不够;缺乏对基本法律法规的了解掌握;因其他主体违约而连带作为被告上法庭;因地方保障不到位导致卷入诉讼;因不主动履行法律确定的义务进入司法程序等方面。未来，应从档案馆自身、档案行业组织和行政监管三个维度建构对策，以对档案馆诉讼风险有力防范之。

Abstract： the social functions and social image of Archives determine that it is not suitable to be involved in litigation disputes with others. At present， the cases involving archives in our country are increasing year by year， the cases are widely distributed and they appear in court as defendants. Based on the archive's own dimension， the causes of such cases mainly lie in the following aspects： insufficient attention to the resolution of pre litigation conflicts and disputes; lack of understanding of basic laws and regulations; joint and several defendants going to court because of other subjects' breach of contract; involvement in litigation due to inadequate local security; entry into judicial proceedings due to non active performance of legal obligations. In the future， countermeasures should be constructed from three dimensions of archives themselves， archives industry organization and administrative supervision， so as to effectively prevent the litigation risks of archives.

本文以分析探讨最高人民法院公布的涉档案馆诉讼案件基本情况为逻辑起点，通过解读和剖析当前我国档案馆涉诉案件的类型、特点以及发生缘由等属性，最终提出档案馆诉讼风险防范的若干思考与建议。

1 我国档案馆涉诉案件实证考察

2020年8月，笔者登录最高人民法院主办的中国裁判文书网统计查证，2012年1月1日至2020年8月1日，全国各级法院共审结各类涉档案馆诉讼案件共计278件（含二审、再审和执行案件），通过多维视角对上述案件进行分析和考察发现，该类案件主要具有以下特征：

1.1 案件呈現出逐年递增态势。通过搜索对比得知，2012年全国各级法院审结的涉档案馆案件1件，2013年审结3件，2014年审结12件，2015年审结23件，2016年审结29件，2017年审结51件，2018年审结54件，2019年审结64件，2020年1月1日至8月1日审结41件（按照目前趋势，2020年涉档案馆诉讼案件数亦会徘徊在2019年的64件上下，仍处于历史高位）。……
