摘 要：[目的/意义]通过高校涉诉知识产权侵权行为分析，侧面发现高校知识产权管理的短板，为提升知识产权保护和管理能力提供较客观、科学的决策依据。[方法/过程]文章以高校涉诉知识产权司法判例文书数据为样本，采取文本分析法对高校知识产权侵权行为进行了客观分析及数据可视化展示，进而反映了高校知识产权管理的现状。[结果/结论]高校涉诉知识产权侵权行为主要表现为侵犯著作权及著作权合同纠纷，这为高校知识产权管理的深入研究提供了较全面、基础、客观的决策参考。

Research on the Status of Intellectual Property Management in

University Based on Infringement Analysis

Abstract：[Purpose/Significance]Through the analysis of intellectual property infringement in colleges and universities，the shortcomings of intellectual property management in colleges and universities are found to provide objective and scientific decision-making basis for improving intellectual property protection and management capabilities.[Method/Process]The article took the data of the judicial judgment of intellectual property rights in colleges and universities as a sample，and adopted the text analysis method to analyze the status quo of intellectual property infringement in colleges and universities，giving data visualization and then reflected the status quo of intellectual property management in colleges and universities.[Result/Conclusion]Infringements of intellectual property rights in colleges and universities were mainly manifested in copyright infringement and copyright contract disputes，which provided a comprehensive，basic and objective decision-making reference for the in-depth study of intellectual property management in universities.

黨的十八届三中全会通过的《中共中央关于全面深化改革若干重大问题的决定》给高校建立产学研协调创新知识产权管理体系提出了紧迫的时代要求[1]。通过对高校知识产权侵权现状进行实证分析，发现其侵权行为的演化特点，能够侧面反映出高校知识产权管理的现状，为提升高校知识产权的保护和管理能力提供较客观、科学的决策依据，从而有利于规范高校科研秩序，促进高校作为国家知识产权战略实施重要基地，其创新功能的有效发挥。

现有高校知识产权管理的研究主要集中在现状梳理与对策建议、国家知识产权战略、专利、知识产权教育与人才培养、科技创新以及高校图书馆信息行为等方面，研究方法多以理论阐述为主或辅以简单的统计、调研数据。……
