摘要：中国与东盟建立对话关系30年来，双方劳务合作日益引起各方关注与重视，对外劳务合作中妥善的制度安排是促进涉外投资合作的重要环节，亦是建立中国—东盟全面战略伙伴关系和构建更为紧密的中国—东盟命运共同体的重要内容。文章通过梳理中国对外劳务合作的法律制度环境，分析推进中国与东盟劳务合作存在的制度性缺失， 从完善中国跨境劳工法律制度、 商签双边劳务合作协议、契合国际劳工标准条款、健全冲突法规则、保护外派务工者权利与利益等方面，提出新时代进一步促进中国与东盟国家劳务合作的法律策略。

Legal Issues and Countermeasures of Labor Cooperation between China and ASEAN Countries

Abstract： Since the establishment of dialogue relations between China and ASEAN 30 years ago， labor cooperation between the two has attracted increasing attention from all sides. Appropriate institutional arrangement of foreign labor cooperation is an important link in promoting foreign investment cooperation， and an essential part of establishing a China-ASEAN comprehensive strategic partnership and building a closer China-ASEAN community with a shared future. The paper combs through foreign labor cooperation in China's legal environment， analyses the institutional deficiencies in advancing labor cooperation between China and ASEAN， put forward legal strategies to further promote labor cooperation between China and ASEAN countries in the new era from the aspects of improving China's cross-border labor legal system， negotiating and signing bilateral labor cooperation agreements， conforming to international labor standards， improving laws and regulations on conflict， and protecting the rights and interests of migrant workers.

中国与东盟地缘相近、人文相通，自中国与东盟建立对话关系30年来，走出了一条睦邻友好、合作共赢的光明大道，实现了双方关系跨越式发展。伴随着中国—东盟自由贸易区升级版的建设，高质量共建“一带一路”和共同推动签署的《区域全面经济伙伴关系协定》（RCEP）即将生效，作为国际服务贸易项下重要的劳务合作亟需予以关注。在中国与东盟建立对话关系30周年，面向构建更为紧密的中国—东盟命运共同体之际，总结梳理中国对外劳务合作的法律制度环境，分析研判推进中国与东盟劳务合作存在的制度性缺失，从完善中国跨境劳工法律制度、商签双边劳务合作协议、契合国际劳工标准条款、 健全冲……
