摘 要：习近平法治思想成为指导我国商事审判发展的根本遵循。对标世界银行的营商环境评价体系，我国的营商环境在便利化、国际化、法治化的要求下均取得长足的进步。通过对世界银行营商环境评价体系的全面检视，结合与商事审判密切相关的“执行合同”“保护少数投资者”“获得信贷”“办理破产”四个方面指标，尤其评估中的指标短板项为指引，对影响营商环境的相关专题要素进行深入分析。对现阶段商事审判发展特点的实证分析，对以商事审判为主体的营商环境法律体系，在市场准入、市场交易、公司治理、市场融资、市场退出五个方面的优化路径进行系统论证和深入考察。

Study on the Development Path of Chinas Commercial Trial Under

the Guidance of Xi Jinping Thought on the Rule of Law

——An Empirical Study Based on the Shortcoming Index of the

World Banks Business Environment Assessment

Abstract：Xi Jinping Thought on the rule of law has become the fundamental guidance for the development of commercial trials in China. Based on the World Banks assessment system for business environment， Chinas business environment has made great progress under the requirements of facilitation， internationalization and rule of law. Based on a comprehensive review of the World Bank Business Environment Evaluation System， and guided by four indicators closely related to commercial trials， such as “execution of contracts”， “protection of minority investors”， “access to credit” and “bankruptcy management”， especially the shortcoming index in the evaluation， this paper makes an in-depth analysis of relevant thematic factors affecting the business environment. Through the empirical analysis of the development characteristics of commercial trial at the present stage， and the commercial trial as the main body of the business environment legal system， there are the following aspects to optimize and investigate the path of systematic demonstration; in the market access， market transactions， corporate governance， market financing and market exit.

党的十八大以来，习近平总书记围绕优化营商环境发表了一系列重要论述，强调“法治是最好的营商环境”，要“不断完善市场化、法治化、国际化的营商环境”。在互联网高速发展的今天，经济全球化的进程日益加快，营商环境建设的重要性也日益凸显。对中国而言，法治化营商环境建设是当前中国优化经济结构的重点和难点，这其中尤其以商事审判为中心。根据《经济学人》统计，目前世界上有50多种以经济发展为主题的商业报告，但世界银行出台的《营商环境报告》无疑是其中影响力最大的。在优化营商环境领域，中国不仅应当参考世界银行的评估，还要努力提高国际排名。……
