摘 要：近年来，经历了国家财政部数次“清库和整改”浪潮后的PPP项目逐渐进入了履约阶段。原以为PPP项目就此一帆风顺地前进，没想到看似平静的海面居然埋藏着太多漩涡，政府和社会资本方仍然面临较大的风险，稍有不慎就会陷入泥泞之中，甚至导致项目提前终止。传统项目在实施过程中会遇到项目变更、项目超概、土地等问题，PPP项目也不例外，但政府付费延期、绩效监管、政策变化、使用者付费不足等是其独有的风险。该文是以PPP项目履约阶段为研究对象，分析各类风险产生的原因并提出相应对策。

Exploring the Issues in the Performance Phase of PPP Projects

Abstract： In recent years， PPP projects that have experienced several waves of “clearance and rectification” by the Ministry of Finance have gradually entered the performance phase. I thought that the PPP project would proceed smoothly， but I didn’t expect that the seemingly calm sea was buried with too many vortices. The government and social capital were still facing greater risks. If Fang was careless， he would fall into the mud and even lead the project ahead of schedule. termination. Traditional projects will encounter project changes， project over-provisions， land and other issues during the implementation process. PPP projects are no exception. However， government payment delays， performance monitoring， policy changes， and insufficient user payment are their unique risks. This article takes the PPP project performance stage as the research object， analyzes the causes of various risks and proposes corresponding countermeasures.

PPP項目是政府方与社会资本方依法进行合作的项目，自国务院发布《国务院关于加强地方政府性债务管理的意见》（国发〔2014〕43号）以来，PPP项目给地方政府带来了巨大的发展机遇。通过利用政府与社会资本这一合作模式，各地启动了数万亿资金规模的项目，进一步完善了各地方的基础设施和公共服务，创造了巨大的社会效益、经济效益、环境效益、生态效益等。但目前全国各地仍有大量的PPP项目在执行过程中，出现不同程度的隐患，需要参建各方齐心协力探索，及时解决实施过程中出现的各类隐患和问题。

1   PPP项目履约阶段的困境

在国家相关部门出台文件的要求下，各地方政府新上的PPP项目前期工作更加规范，项目入库审核也越来越严格。原以为项目将按照合同约定的条款顺利实施，但从目前项目的履约情况来看，项目实施期间出现了诸多问题，导致项目推进缓慢，使得PPP模式陷入新的困境之中[1]。……
