摘要 随着电子商务的快速发展，食品的经营也借助网络平台快速地发展起来，网络食品在满足人们需求的同时，也带来了诸多食品安全问题，因而如何维护网络食品安全、保障网购消费者的合法利益和提高监管部门的监管实效等问题也接踵而至。通过对网络食品经营监管存在问题进行的详细分析和研究，针对市场监管过程中存在的问题，笔者从网购消费者、电子商务自营平台、监管部门等方面进行了研究分析，并对网络食品安全的监管方式提出了一些合理性建议。

Abstract As the rapid development of ecommerce， food business has also been rapidly developed with the help of the network platform. While online food satisfies peoples needs， it also brings many food safety issues， so how to maintain online food safety， safeguard the legitimate interests of online shopping consumers， improve the effectiveness of the regulatory authorities have been important issues with great concern. This work analyzes the problems existing in the supervision of online food business， and discusses the problems in the process of market supervision from the aspects of consumer， ecommerce platform and regulatory authorities. This study puts forward several reasonable suggestions for the supervision and control of online food safety.

隨着中国电子商务平台的日益壮大，网络食品得到了迅猛地发展。网络食品以其自身的方便、多样、实惠等诸多优点吸引到庞大的消费群体。

然而在网络食品经营带来的消费升级同时，各种各样的问题也慢慢的显露出来。由于网络食品经营监管方面的滞后，使得网络食品安全问题日趋严重。如网络平台上各式各样的食品，其质量往往是良莠不齐、以次充好、以假乱真占多数，个别电商平台存在对商家资质审核不严、及购进记录审查不严的现象，网络食品经营的低门槛，使得没有《食品生产许可证》的商家也可以在网络平台上实现自产自销，导致消费者遇到食品安全问题而无法追溯，网销主体中大部分经营者未履行主体责任，企业责任人主体对《中华人民共和国食品安全法》法律意识不够强，同时，监管部门对网络食品经营管理没有到位和执法体系不够完善导致执法过程中存在漏洞[1]。……
