摘 要 当前，司法考试制度与法学教育间的关系不但是我国急需研究的重要课题，而且是理论界争议较大的一个焦点。以现阶段法学教育情况为基础，结合近年来司法考试推广特点，明确新时代发展对教育体系提出的要求，分析法学教育与司法考试的关系，并整合以往发展经验明确未来发展方向。

Abstract At present， the relationship between the judicial examination system and legal education is not only an important subject that needs to be studied urgently in our country， but also a focus of controversy in the theoretical circles. Based on the current situation of law education and the characteristics of judicial examination popularization in recent years， this paper clarifies the requirements for education system put forward by the development of the new era， analyzes the relationship between law education and judicial examination， and integrates the past development experience to define the future development direction.

通过了解实践发展情况可知，处理司法考试与法学教育两者关系的核心问题就是如何预防法学教育因为司法考试的实施而陷入困境，或如何避免出现“双学校现象”。从理论入手，司法考试与法学教育最大争议是，司法考试是否要成为法学教育的指挥棒。为了保障司法考试与法学教育有效落实，下面对法学教育与司法考试进行深层探索。

1 法学教育与司法考试的区别分析

具体内容主要分为以下几点：其一，法学教育的功能是培育人才，而司法考试的功能是筛选人才；其二，法学教育目标是多样化，它不只能培育法律职业人才，还会培育治国人才，更可以优化全国公民的法律意识，而司法考试是选拔合格的法律职业人才；其三，法学教育的内容非常多，而司法考试的范围存在限制，不能展现法学教育的所有内容。[1]

2 法学教育与司法考试的关联分析

2.1 司法考试是连接法学教育与法律职业的桥梁

在经过系统化的法学教育后，法学专业毕业生并不能直接进入岗位工作，而是要通过统一的司法考试，并获取专业资格证后才能上岗入职。……
