深圳市2011—2015年医疗执业违法行为行政处罚情况分析

目的通过对深圳市2011—2015年医疗执业违法行为行政处罚情况进行分析，找出医疗机构医疗执业违法行为发生的规律和重点，为卫生监督部门提高医疗机构监管效能、促进医疗机构依法执业提供参考。方法对2011—2015年深圳市各级卫生监督部门对全市医疗执业违法行为行政处罚情况，从案件发展趋势、案件来源、区域分布、案件案由等方面进行分析。结果深圳市医疗执业违法行为行政处罚宗数2011—2014年间逐年增加，2015年有所减少；医疗执业违法行为案件的来源以卫生监督部门日常监督发现为主；违法行为主要集中在原特区外；医疗机构违法行为中以使用未取得处方权的人员开具处方等4种案由最为常见。结论卫生监督部门要侧重加强对原特区外区域医疗执业违法行为的监督查处工作，加大对医疗机构使用未取得处方权的人员开具处方的违法行为的打击，引导医疗机构自觉依法执业，切实维护和保障市民群众的健康权益。

［Abstract］Objective To analyze the administrative penalty of medical practice unlawful act in Shenzhen from 2011 to 2015，find out occurrence law and key points of medical practice unlawful act of medical institutions for summary，and provide reference for improving the supervision efficiency of medical institutions and promoting the lawful practice of medical institutions of health supervision department.Methods The administrative penalty of medical practice unlawful act in the whole city was analyzed from the aspects of case development trend，case source，regional distribution and case causes by the health supervision departments of different levels in Shenzhen from 2011 to 2015.Results The administrative penalty case number of medical practice unlawful act in Shenzhen from 2011 to 2014 gradually increased，and decreased in 2015，the source of medical practice unlawful act was mainly daily supervision and discovery of health supervision department，and the unlawful act was mainly outside original special zone，and the 4 case causes including prescriptions issued by staff without obtaining right to prescribe in the unlawful act of medical institutions were most common.Conclusion The health supervision department should pay attention to enhancing the supervision and investigation work of medical practice unlawful act outside the original special zone，reinforce the strike of unlawful use of prescriptions issued by staff without obtaining right to prescribe，guide the medical institutions consciously practice according to law and practically maintain and ensure the health benefits of people.
