促进中国对外援助发展的法治化建议

［摘要］《中共中央关于制定国民经济和社会发展第十三个五年规划的建议》提出“扩大对外援助规模，完善对外援助方式”。中国对外援助体系已经形成，对外援助活动经历了法治缺失到逐渐完善的过程。当前，我国援外事业面临着受援助国家亟须经济转型压力大，对外援助管理体系不完善，缺乏完整的对外援助理论指导，政府在援外角色意识存在错位等多种制约因素。为此，亟须优化援外结构，完善管理体系，丰富援外理论，实现援外事业法治化。

［Abstract］“13th Five-Year Plan”had put out that“enlarge the scale of China’s foreign aid and improve the way to foreign aid”.China's foreign aid system has been built.Aid activities have been gradually improved from the lack of rule of law.Now,foreign aid is facing the pressure of economic transformation that donor countries needed,foreign aid management system is not perfect,lacks complete foreign aid theory guidance,the government’s role in care consciousness exist dislocation and other reasons,which prevent the development of China’s aid.Therefore,it’s urgent to optimize the structure of foreign aid,strict management system, enrich the theory of foreign aid,and legalize foreign aid system.

一、问题的提出

对外援助是指国家或者政府根据宪法等相关法律规定，实行与援助国和受援国经济和社会发展水平相适应的方式，履行国际义务的行为。对外援助是承担大国责任的体现，也是树立大国形象的重要途径。中国自建国之初就开始对蒙古国、朝鲜、越南等周边国家的对外援助：劳动力援助、军事援助、资金援助。截止2013年，中国累计对外提供援助金额达3455亿元人民币。其中无偿援助1385亿元，无息贷款838亿元，优惠贷款1233.1亿元①资料由笔者通过整理2014年和2010年《中国对外援助白皮书》所得。。随着我国经济实力增长、综合国力增加，我国对外援助规模和水平不断提高。在援助方式上，由军事、物资、资金援助逐渐转变为成套项目、物资援助、技术援助、人力资源援助共同发展的局面。……
