摘  要：技术合同认定对于加速科技成果的转化、强化技术市场的管理具有非常重要的意义，所以近些年我国相关的政府机构对于推进技术合同认定工作采取了一系列的措施。该文主要分析当前技术合同认定工作过程中存在的一些实际问题，根据相关规定并结合工作实践得出的处理经验提出合理的建议，希望能够为加快我国科技创新发展提供一定程度的助力。

Abstract： The recognition of technical contracts is of great significance for accelerating the transformation of scientific and technological achievements and strengthening the management of technology market. Therefore， in recent years， China's relevant government agencies have taken a series of measures to promote the identification of technology contract. In this paper， it mainly analyzes some practical problems existing in the process of technical contract identification， and puts forward reasonable suggestions based on relevant provisions and processing experience obtained from work practice， hoping to provide some help to accelerate the development of science and technology innovation in China.

对于当事人来说，技术合同涉及到技术开发、技术转让、许可、咨询或服务等相关内容，以合同的形式明确双方的权利与义务。在技术合同中需要注意的事项比较多，履行合同的期限也比较长，在合同认定过程中必需严格按照相关的法律条款执行，否则会引起不必要的法律问题。技术合同认定部门则需要对合同文本进行核查，确定合同性质属于技术合同范畴，并确定属于何种技术合同，确保符合相关的法律规范，并对双方的交易金额、技术性收入以及酬劳等内容进行核定。做好技术合同认定工作对于促进我国科技成果转化、提高产业科技水平具有非常重要的意义。

1技术合同概述

1.1技术合同的分类

在我国原《合同法》中对技术合同做出了说明，技术合同可以分为四个大的类别：技术开发、技术转让、技术咨询、技术服务。就在今年初刚刚颁布实施的《中华人民共和国民法典》将技术许可合同从技术转让合同中分离出来，成为第五类技术合同[1]。……
