摘要：公共图书馆，即向社会公众免费开放，并提供查询、借阅等相关服务，是开展社会教育的有效公共文化基础设施，同时也是社会主义公共文化服务中的重要组成部分。但就目前情况而言，公共图书馆发展正面临着来自知识产权方面的挑战。该文主要探究其知识产权风险现状分析、风险类型及规避知识产权风险策略，以期进一步促进我国公共图书馆长期可持续发展以及更有生命力。

Analysis on the Risks and Avoidance of Intellectual Property Rights of Public Libraries

Abstract： Public libraries， which are free to the public and provide related services such as inquiry and borrowing， are an effective public cultural infrastructure for social education and an important part of socialist public cultural services. But as far as the current situation is concerned， the development of public libraries is facing challenges from intellectual property rights. This article mainly explores the analysis of the status quo of its intellectual property risks， the types of risks and the strategies for avoiding intellectual property risks， in order to further promote the long-term sustainable development and more vitality of public libraries in my country.

公共圖书馆是我国公共文化设施中的重要组成部分，目前，我国正在进行大规模的公共图书馆建设，他们将对公众文化发展产生不可估量的社会效益。但是，知识产权问题已经成为制约公共图书馆发展的重要影响因素。知识产权所独有的私有性与公共图书馆的公开共享之间具有尖锐的矛盾纠纷。因此，解决公共图书馆知识产权风险规避是值得思考的重要课题。

1 风险现状

1.1 环境风险

公共图书馆知识产权风险来源有很多，笔者经过经验总结，将其主要概括为以下几个方面。

1.1  环境风险

主要体现在管理层面，即图书馆人员内部管理、图书馆业务管理与读者群体管理三大部分。一方面，由于图书馆工作人员在日常管理中缺乏相应的知识产权意识，导致读者群体在享受公共图书馆的文化熏陶时，忽略了知识产权法律约束，形成知识侵权现象;另一方面，公共图书馆业务管理和读者群体管理存在管理机制缺陷，在业务建设、指导读者等都存在管理薄弱环节。……
