摘 要：涉军法律援助制度是中国特色法律援助事业的重要组成部分，是实现军人军属维权诉求的法治运行有效机制。军地协作开展法律援助是构建完整法律援助制度的关键一环，具有独立的司法价值和卓殊的社会价值。随着军民融合战略持续深度发展，强化军地协作可在军地统筹模式下实现资源共享，军地互带互动有助于克服涉军法律援助“名实不符”的形式化弊端，破除军队“单兵作战”的片面化倾向，解决基层部队法律援助服务“供需失衡”的消极化难题。

Research on the Mode and Implementation Path of Military-local Cooperation for Military-related Legal Aid

Abstract：The military-related legal aid system is an important part of the legal aid with Chinese characteristics， and it is an effective mechanism of legal operation to realize the demands of safeguarding the rights of soldiers and their families. The military-civilian cooperation in the development of legal aid is a key part of the establishment of a complete legal aid system， which has independent judicial value and outstanding social value. With the continuous and in-depth development of the military-civilian integration strategy， strengthening military-civilian coordination can achieve resource sharing under the military-civilian coordination mode. The mutual interaction between military and local governments can help overcome the formal malpractice of military-related legal aid “inconsistent in name and reality” and break the army “normal” one-sided tendency， solve the negative problem of the “imbalance between supply and demand” of legal aid services for grassroots troops.

法律援助隶属于公共法律服务体系，在保障人权、扶困济贫，消弭纷争、维护稳定方面发挥了积极作用。作为法律援助内容之一的涉军法律援助制度，旨在服务军人军属这类特殊社会群体，通过建立专门服务组织以法律咨询、诉讼代理等形式为军人军属提供无偿法律援助，其功能在于解军难、维军权、稳军心，涉军法律援助是实现军人军属维权诉求的法治运行有效机制。

据《中国法律援助制度发展报告（2019）》载，“2018年共办理法律援助案件145万余件，其中共为51万余人次农民工、12万余人次老年人、13万余人次未成年人、5万余人次残疾人和3301人次军人军属提供了法律援助服务。”^[1]国家统计局数据显示，截至2018年12月我国共有现役军人340余万，与军属人数合并超过1000万。分析受援人次数据可知，接受法律援助的军人军属比例仅为总数的0033%。……
