摘  要：随着新一轮科技革命和产业变革，大数据已成为国家基础性战略资源，数据安全治理已成为全球治理的重要课题。实施公安大数据战略，是实现新时代公安机关跨越式发展的略选择。该文结合公安大数据侦查与公民隐私权保护现实问题，从博弈论视角展开分析。在阐述公民个人信息是大数据侦查的数据基础的基础上，剖析大数据侦查与公民隐私保护的现实冲突，提出大数据侦查中隐私权保护的实现路径，旨在为进一步做好大数据侦查与公民隐私权保护提供经验借鉴和有益参考。

Big Data Investigation and Protection of Citizen's Privacy Right Based on Game Theory

Abstract： With a new round of scientific and technological revolution and industrial reform， big data has become the basic strategic resource of the country， and data security governance has become an important subject of global governance. The implementation of public security big data strategy is a brief choice to realize the leapfrog development of public security organs in the new era. This paper analyzes the real problems of public security big data investigation and citizen privacy protection from the perspective of game theory. On the basis of expounding that citizen's personal information is the data basis of information investigation， this paper analyzes the actual conflict between information investigation and citizen's privacy protection， and puts forward the realization path of privacy protection in information investigation. In order to further do big data investigation and citizen privacy protection to provide experience and useful reference.

隨着现代信息技术的进一步发展，犯罪活动呈现出网络化、数据化、智能化的新特征、新趋势，大数据侦查已然成为新形势下侦办案件的必然要求和必由之路。所谓大数据侦查，即在“大数据引导侦查”的战略思维下，依托大数据技术、网络信息技术和各类数据资源，以犯罪预防、侦查破案、嫌犯追逃为核心目标，破解侦查难题、扩展侦查技术、优化侦查业务的一种新型侦查模式。侦查机关有权对特定犯罪展开大数据侦查有正当性基础，但大数据侦查对他人居住安全、通信自由及隐私等权利有很大的“杀伤力”，如若其不当运用，必将给公民隐私权造成重创。在大数据侦查模式下，如何正确认识处理、准确把握大数据侦查权和公民隐私权的关系，在提高办案效能的同时充分保障公民隐私权，值得思考和研究。……
