摘 要：在倡导高质量发展的时代背景下，我国专利申请数量连续8年位居世界首位，从量变到质变的突破是当前需要解决的首要问题，高价值专利的培育是供给侧改革下提升创新质量的现实需要。当前，有必要以我国高价值专利培育现实问题为导向，将战略生态管理理论作为理论基点，有效解决高价值专利的培育环境导向性问题、培育资源保障性问题以及培育主体交互性问题，并从技术创新的技术生态位向市场生态位跃进的全过程入手，构建涉及高价值专利培育全程的优化方案。

High Value Patent Cultivation and Optimization Based

on Strategic  Management Theory

Abstract： In the context of advocating high-quality development， the number of patent applications in China has ranked first in the world for eight consecutive years. The breakthrough from quantitative change to qualitative change is the primary problem that needs to be solved at present， and the cultivation of high-value patents is a practical need to improve the quality of innovation under the supply-side reform. At present， it is necessary to take the practical problems of China's high-value patent cultivation as the guide， and use the strategic ecological management theory as the theoretical basis to effectively solve the problem of environmental orientation， cultivation of resource security and the interactivity of cultivation subjects of high-value patents，and start from the whole process of the leap from the technological niche of technological innovation to the market niche， so as to construct an optimized plan involving the entire process of cultivating high-value patents.

在新时代“倡导创新文化，强化知识产权创造、保护、运用”的大背景下，为实现提升我国创新质量推动供给侧结构性改革的根本目标，有必要完成我国知识产权从量变到质变的根本性跨越。加大高价值知识产权培育力度、深入实施专利质量提升工程以及大力培育高价值核心专利是知识产权强国建设的关键一环。2019年7月，《高价值专利（组合）培育和评价标準》（Q/JHZZC 0001—

2019）公开发布，如何实现高价值专利的成功转化已经逐步聚焦成为我国专利事业发展的热点问题。

本文基于战略生态位管理学（Strategic Niche Management， SNM）理论的视角，从其思想内核和核心要素出发，重新审视我国高价值专利培育的发展现状及现实难题，并试图通过该理论对现有高价值专利培育体系提出具有价值指向的完善性意见。……
