摘  要：我国高校法学专业的模拟法庭教研状况存在着演练形式化、案例选取不当、角色配置不完善、课程设置不合理等诸多问题。2020年由于新冠肺炎（COVID-19）疫情的原因，大多数高校采取线上教学的模式，增加了模拟法庭课程的教学难度，需要对现有的模拟法庭课程进行改革，建议在真实案例的基础上选择性优化，实现导师团队的分组指导，建立动态跟踪式的评价系统，建立模拟法庭的助教团队。模拟法庭的教学规划不仅仅要克服传统模拟法庭的问题，还应着手建立线上教学的初步方案，统一线上模拟庭审工具，实现线上分组指导，建立电子化卷宗管理制度等等。

Abstract： There are many problems in the form of practice training， improper case selection， imperfect role configuration， and unreasonable curriculum setting in the simulated court teaching and research situation of law majors in Chinese universities. Due to the New Coronary Pneumonia （COVID-19） epidemic in 2020， most colleges and universities adopt an online education model， which increases the difficulty of teaching mock court courses. It is necessary to carry out reforms， such as selective optimization on the basis of real cases， realize online group guidance of the mentor team， establish a dynamic tracking evaluation system， establish a mock court teaching assistant team， unify online court hearing tools， etc. The teaching planning of the moot court should not only overcome the problems of the traditional moot court， but also set up a preliminary plan for online teaching， unify the online mock court trial tools， realize online group guidance， establish an electronic file management system， and so on.

大部分高等院校的法学专业培养目标仅强调基础知识和专业知识的掌握，对于创新能力和实际工作能力的培养有所忽略。因而形成了学生综合素质不高，认识问题、判断问题、解决问题的能力较差，遇到实际法律问题茫然无措的情况[1]。上海对外经贸大学作为涉外法律人才教育培养基地之一，为提升在校生的法律实务能力，与众多高校法学院一样，我校也引入了“模拟法庭”教学①。本文以上海对外经贸大学2020年度上学期35人班级问卷调查结果为主，探讨疫情下以线上教育为主的民事诉讼法课程模拟法庭演练环节的设计和传统模拟法庭的完善路径。
