摘  要：地方立法体系是科技创新中心建设的强有力保障之一。文章以地方科技创新中心立法为研究对象，分析了科技创新中心立法的内涵、外延、理论依据、地方科技创新立法的阶段和特点，并采取对比分析法对上海、深圳和成都等地方政府推进科技创新中心建设立法的需求、思路、框架和重点制度等进行研究。文章认为，省、市科技立法比较结果的启示在于：地方政府要进一步研究确立区域科技创新基本法制度;要处理好新形势下科技创新基本法与现行法规的关系;要允许区域立足改革创新实践需要根据授权作变通规定;要加强基础研究和科技人才的立法制度保障等，并据此提出了对北京制定科技创新中心条例的启示建议。

Abstract：The local legislation system is one of the strong guarantees for the construction of science and technology innovation center. This paper analyzes the connotation and theoretical basis of the legislation of the science and technology innovation center，studies the stages and characteristics of the local science and technology innovation legislation，analyzes the needs，ideas，framework and key systems of promoting the construction of the science and technology innovation center in Shanghai，Shenzhen and Chengdu. This paper holds that the Enlightenment of the comparison of provincial and municipal science and technology legislation lies in：further research and establishment of the basic law system of regional scientific and technological innovation，handling the relationship between the basic law of scientific and technological innovation and the current laws and regulations under the new situation，allowing the region to base on the reform and innovation practice，making flexible provisions according to the authorization，and strengthening the legislative system guarantee of basic research and scientific and technological talents，and puts forward some enlightenment suggestions for Beijing to formulate the regulations of the science and technology innovation center，which has very important theoretical value Practical significance.

科技创新中心建设是新时期推动原始创新能力提升和區域创新发展的一项重大国家发展战略。党的十八大以来，国家推动实施创新驱动发展战略，有步骤地在全国布局建设科技创新中心。2020年10月29日，中国共产党第十九届中央委员会第五次全体会议通过的《中共中央关于制定国民经济和社会发展第十四个五年规划和二〇三五年远景目标的建议》明确指出，支持北京、上海、粤港澳大湾区形成国际科技创新中心[1]。成渝地区双城经济圈建设被确立为国家战略，党中央明确提出要建设具有全国影响力的科技创新中心。法律法规作为规则之治的重要载体，对加快科技创新中心建设、促进经济高质量发展具有重要意义。……
