摘  要：在权力和权利的视角下，档案法律条文表面内容的变化隐含、印证了档案法律法规体系变迁过程中不变的内涵，即法的自我完善与发展过程中对档案形成部门、集中保管部门、行使档案主管职权部门权力的制约与规范、责任履行的监督，对非国有档案所有者保管权、处置权、利用权的维护，对档案利用者权利的明确、保障和提升。

Abstract： Under the perspective of power and rights， the changes in the surface content of the archives legal provisions imply and confirm the unchanging connotation in the process of changes in the archives legal system. In the process of self-improvement and development of the archives， it restricts and regulates the authority of the archives formation department， the centralized storage department， and the department that exercises the authority of the archives authority， and the supervision of the performance of responsibilities. 从权力和权利的视角审视2020版《档案法》与之前的档案法律法规，不难发现档案法律条文表面内容的变化隐含、印证了档案法律法规体系变迁过程中不变的内涵。这些内涵包括权力的制约与规范、责任履行的监督、权力的维护、权利的明确与保障等方面。

1 对档案形成部门权力的制约与规范、责任履行的监督

1.1 对档案收集权力的制约和规范

1.1.1 从档案规章变迁看机关档案收集范围的细化、规范化。收集是档案管理的基础性工作。以機关档案工作为例，从不同时期的档案规章来看，机关档案的收集范围呈现出从粗线条勾勒、模糊性指向到大框架分类、小条文细化的趋势，从党、政、工、团等有类别性描述、无操作性指引到分类清晰、条目细致、内容指向确定、外延范围限定、操作更加便捷的变化。

1983年4月28日中共中央办公厅、国务院办公厅印发《机关档案工作条例》。第十一条，凡机关工作活动中形成的具有保存价值的文件材料（包括党、政、工、团以及人事、保卫、财会等工作中形成的文件材料），均由文书部门或业务部门进行整理、立卷，并定期向档案部门归档。……
