摘要法律是一种非常严肃的文本，法律英语作为一种有规约性的语言，其最重要的特点就是用词准确。因此在翻译中译者一定要慎重地选择翻译策略，准确地译出原文的内容，传达源文本的信息。本文拟就依照尤金·奈达的“功能对等”理论对《中华人民共和国合同法》两个英译本进行对比研究，就法律英语和法律文本翻译时可以采用的翻译策略来进行探讨。

AbstractLaw is a very serious text. As a prescriptive language， the most important feature of legal English is the accuracy of words. Therefore， in translation， the translator must carefully choose translation strategies， accurately translate the content of the original text and convey the information of the source text. This paper intends to make a comparative study of the two English versions of "The Contract Law of the People’s Republic of China" according to Eugene Nida’s "functional equivalence" theory， and explore the translation strategies that can be used in the translation of legal English and legal texts.

從语言本身的角度来看，法律语言和其他社会语言一样，是人们根据社会文化环境和交际目的等语用因素，在长期使用中形成的具有自身用途和规律的不同语言形式。法律语言属于专门用途语言，具有较强的程式化，因此翻译更趋于保守，以期实现其规范和提供信息的功能，进而实现法律的权威性。

1法律翻译相关理论

与普通语言不同，法律语言是具有权威性和约束力的法律载体。法律的应用涵盖范围包括：法规，合同，条例等。所有这些文件都涉及加强义务和赋予权利的内容。词法上，往往选择正式词语；句法上，多用严密相扣、复杂冗长的句子。

1.1发展概述

在法律翻译史上，有很多相关研究。Newmark认为直译是最基本的翻译过程。后来，一些关于法律翻译的观点将翻译从纯粹的直译中解放出来，“Vermeer的目的论使翻译理论现代化。他创造性地将翻译的功能确定为选择翻译策略的主要标准。……他认为，应根据每种情况下的具体交际功能以不同的方式进行翻译。
