【摘 要】世界银行货款因其额度大、还款周期长、优惠幅度大等优点 ， 而受到发展中国家的青睐。但其独特的理念和操作规范，与我国有很大差异，造成在使用贷款过程中存在种种问题。以世行贷款“焦作市绿色交通与交通安全改善项目”为例，分析世界银行贷款项目与国内项目在适用法律、操作流程等方面的区别，以及重视示范效应、重视机构能力建设、规范化的操作流程、完善的风险控制机制等特点，并提出相应的注意事项。

【Abstract】The World Bank loans are favored by the developing countries because of its large amount， long repayment cycle， preferential margins and other advantages. But because of its unique concept and operation standard， it is very different from domestic projects，which causes many problems in the process of using the loan. Taking “the Green Transportation and Traffic Safety Improvement Project of Jiaozuo City ”as an example， this paper analyzes the differences between the World Bank loan projects and domestic projects in terms of applicable laws and operational procedures， and its other characteristics such as attaching importance to demonstrative effect， attaching importance to institutional capacity building，standardized operational procedures， and perfect risk control mechanism. In the end， this paper puts forward the corresponding precautions.

近日经过世界银行（以下简称“世行”）执行董事会批准，焦作市“绿色交通与交通安全改善项目”1亿美元贷款正式生效。在长达3年的前期准备工作中，发现世行贷款项目和国内的项目无论在理念上还是操作方式上都存在很大的差异，有其独特性，需要引起足够的重视。主要表现在以下几个方面。

1 适用法律不同

国内的项目遵行的是国内法律法规，但是世行的项目，包括配套资金，遵循的是世行的相关规定。例如在招标采购当中，国内的主要依据是《中华人民共和国招标投标法》以及《招投标法实施细则》。但世行的依据是《货物、工程和非咨询服务采购指南》、《咨询服务采购指南》等。对此，招投标法67条也有明确的规定：“使用国际组织或者外国政府贷款、援助资金的项目进行招标，贷款方、资金提供方对招标投标的具体条件和程序有不同规定的，可以适用其规定，但违背中华人民共和国的社会公共利益的除外”。……
