【摘 要】法律学习的困境需要从法学思维能力寻求破解之法，而法律思维能力训练的前提即是明确的体系构建。法律思维能力的三阶体系，以基本的法律概念与法律价值为骨架，以法律人的逻辑推理方式为脉络，以实践与理论并行的联想运用能力为血肉。基于此法律思维能力的三阶体系，培养法律思维能力的方式有：抓住基本价值概念法、二重分法、思维导图法等方法。

【Abstract】 The dilemma of legal learning needs to be solved from legal thinking ability， while the premise of the cultivation of legal thinking ability is a clear system construction. The third order system of legal thinking ability takes the basic legal concepts and legal value as the skeleton， and the logical reasoning of the legal person as the context， the associative use ability with practice and theory parallel as the flesh and blood. Based on the threeorder system of the legal thinking ability， the method of developing the legal thinking ability is to grasp the basic value concept， the double division method， the mind mapping method and so on.

1 引言

思维能力是个抽象的概念，其具体内涵往往众说纷纭。无论是日常生活中“想”的能力，还是书面表达上的综合、概括等认识、分析、解决问题的能力，都可以归结为思维能力。思维能力是学习能力的核心，同理，法律思维能力对法律学习来说尤为重要。然而，若能力内涵没有明确的概念界定，就会导致外延模糊不清，从而无法着手培养。因此，在法律学习中，构建完整的法律思维能力体系，明确界定法律思维能力的内涵，并据此总结出培养方法，就显得尤为重要。

2 法律学习困境及思维能力的重要性

法律学习常常以困难著称，根据调查研究总结，其主要难在纷繁复杂的法条、案例。很多同学学习法律的方法是一个字，背；死记硬背应付完考试后，法律知识便会被渐渐遗忘，再次考试时又是崭新一轮的强记。长此以往，徒然劳累，消磨学法热情的同时，学业也难以精进。

教条式知识与理论注定会被逐渐淡忘，日复一日的学习中最终留下的，是法律人面对问题、分析问题、解决问题的思维能力，此亦是法學本科接受法学教育的最终目的[1]。……
