摘 要 在社会高度发展的今天，人民生活水平和质量得到很大程度的提升，社会保持健康有序的发展状态，这些都离不开法律的规范和道德的指引。法律和道德为经济发展奠定坚实的基础，给社会发展创造科学合理的规范和法律约束，最大化地保障社会人民的利益。法律和道德为社会发展做出重要贡献，促进社会平稳发展。与此同时，法律和道德之间在社会规范上产生一些分歧，让法律和道德这两者在对社会行为判定时出现问题。本文针对当前法律和道德之间冲突进行深入分析，探讨在如今法制社会当中如何平衡道德和法律之间的关系，促进道德和法律做到有机融合，更好地服务于社会主义和谐社会。

法律和道德歷来受到人们的重视，这两者具有不同的社会作用和社会效益。法律是国家意志的体现，是服务于执政阶级的重要手段。当前，我国是社会主义民主专政，代表最广大人民的根本利益。法律的制定是考虑服务于最广大人民的利益为基准，能够最大程度上保证人民的权益不受损失。同时，法律具有强制性，在公民权利受到伤害时，能够运用法律手段维护自己利益。道德则是社会群体当中公认的社会准则和行为规范，它没有明确文字规定和约束，它是存在于公民心中的一种价值观。道德是通过社会群体舆论来实现其约束作用，没有具备强制性措施，需要每个公民自觉遵守和自觉维护，形成一种默认的行为准则。……
