摘 要 本文通过介绍上海市近2年在医疗机构中药委托代煎管理上做的工作，为各地区主管部门加强辖区内医疗机构中药委托代煎管理提供参考。上海市率先在全国范围内，从政府层面对医疗机构委托代煎中药进行了规范，形成卫生部门、药监、行业协会协同合作但各有侧重的上海模式。弥补政策空缺，明确各方职责，是促进医疗机构委托代煎中药服务规模化、规范化发展的重要举措。

Introduction to the management mode of TCM trust-agent decocting service in the hospitals of Shanghai*

ABSTRACT To introduce the work of the management of TCM trust-agent decocting service in the medical institutions of Shanghai in last 2 years so as to provide a reference for the competent authority in various regions to strengthen the management of TCM trust-agent decocting service. TCM trust-agent decocting service had been standardized at the government level in Shanghai， which was the first city in China. The cooperation among health organization， drug administration and TCM trade association was defined as Shanghai mode. To make up the vacancy on the policy and clear the responsibility of the parties are the important measures for promoting the standardization of TCM trust-agent decocting service.

随着2003年《中华人民共和国中医药条例》的颁布，国家保护、扶持、发展中医药事业的方针在全国各省市得到了积极的贯彻实施，人们追求中医中药预防治病的热情也越来越高涨。而中药的服用由于需要经过比较专业的煎煮，费时费力，故医院提供煎药服务已经成为常态，为此国家中医药管理局于2009年颁布了《医疗机构中药煎药室管理规范》[1]，通过标准化的方式确保医疗机构煎药质量。

由于患者委托医疗机构煎药的群体不断增加，为满足需求，很多医疗机构都经历了扩张医院煎药室规模到自主寻求企业支持的2个阶段。目前全国范围内，以上海、南京为代表的江浙地区医疗机构以委托企业代煎的模式为主，而北京、天津地区的医疗机构以扩大煎药室规模为主。2种模式的最大差异，在于前者“委托代煎”的行为在2009年之后，是违反《行政法》的“职权法定”的原则，严格意义上属于违法。……
