我国现有的宪法惯例探析

宪法惯例是宪法的重要组成部分，对一国宪法的发展产生重要影响。本文通过对宪法惯例和政治惯例的辨析，阐释了宪法惯例的基本内涵、特征、形成与作用，进而从党的领导角度、人民代表大会的角度、党的领导下的多党合作和政治协商的角度、宪法修改的角度和国家主席的角度从五个方面探讨我国现存的宪法惯例。这些宪法惯例的认定，有着充分的现实和理论依据，对党的执政、国家政治生活和宪法学的发展都有着重要的意义。

［Abstract］The constitutional convention is an important part of the constitution，which has an important influence on the development of a country's constitution.This article try to discriminate the difference of the constitutional convention and the political practice，and explain the basic connotation，characteristics，conformation and effect of the constitutional convention.Then，it explores the existing constitutional convention of China from the leadership of the Communist Party of China，National People's Congress，multi party cooperation and political consultation under the leadership of the Communist Party of China，constitutional amendment and national president these five different aspects.The determination of the Constitutional Convention，having full reality and theoretical basis，has important significance to the development of the party's ruling，the national political life and the constitutional law.

最晚从20世纪90年代开始，宪法惯例就受到我国宪法学者的关注，但一直处于较少受青睐的地位。①笔者通过查找资料发现，从20世纪90年代开始，我国就出现研究宪法惯例的文章，但较少见，主要有梁忠前：论宪法惯例，法律科学1994年第2期（总第54期）；郭春涛：试论宪法惯例的效力，法律科学，2000年第3期（总第103期）等。这种对宪法惯例研究的冷门，很大程度上是因为受到国外不成文宪法和成文宪法这一宪法区分的影响，误将宪法惯例当成不成文宪法国家（如英国）宪法的专利，认为我国作为成文宪法国家，不存在或很少存在宪法惯例，故而，宪法惯例不具有太多的研究价值。不过，从2009年强世功教授发表的《中国宪法中的不成文宪法——理解中国宪法的新视角》一文以后，我国对宪法惯例的研究出现新的变化，许多学者倾注大量精力于其中，出现了许多关于不成文法、宪法惯例研究的文章。……
