摘要：城镇化发展中出现的二元土地困局是推进农村土地制度改革的一个重要诱因。通过分析我国特别是西安市城乡统筹规划中二元土地问题形成的原因，基于产权理论及土地产权属性的视阈，对西安土地改革的现状、问题及路径选择进行了梳理，最后从完善土地产权法规、建立城乡一体化的土地市场、坚持统一城乡土地管理、完善土地管理机制以及社会保障体系等方面提出了西安市土地产权制度改革的创新思路。

Study on Urbanization and Dilemma of Dual Land System on

Perspective of Property Rights—Taking Xian City as an Example

AbstractThe dilemma of dual land system appeared in the development of urbanization is an important incentive to push forward the reform of rural land system. Through the analysis on forming reasons of the dilemma of dual land during the development of urbanization in China especially in Xian City， the present status，problems and path selection of Xian land reform were reviewed and analyzed based on the perspective of theory and property of rights. Finally， the innovative ideas for reform of Xian land right system were put forward from improving the land right laws， establishing the integrative urban and rural land markets， adhering to the uniform urban and rural land management， improving the land management mechanisms and social security system， etc.

城镇化发展不仅是我国现代化进程中的核心战略，也是市场经济体制形成和完善的必然要求，更是广大农民的基本诉求。由于国情的差异和历史遗留问题的诸多限制，中国的城乡一体化道路不可能照抄照搬西方一些国家的城镇化道路。中国已进入协调推进城镇化发展的历史阶段，如何解决好农民市民化后的社会保障问题、农地非农化与粮食安全的矛盾、“空心村”问题以及各利益集团间的矛盾等问题值得深思。不断加剧的工业与农业争地、城市与农村争地、政府与农民争地等诸多矛盾也促使我国政府加快土地制度改革的步伐，这也正是化解各个利益体矛盾的有效办法之一，同时也是统筹城乡发展、消除二元经济结构的关键所在。本文试图从产权创新视阈来破解城镇化发展中的二元土地困境问题。……
