摘 要：随着知识产权越来越被重视，企业专利已经从追求数量转变为提升质量、提升价值，高质量专利、高价值专利成为企业的主流目标。尤其高质量专利是企业专利工作的基础，也是企业专利运营的基础。本文根据专利管理工作实际，设计和分析了基于权利要求项数维度的专利及其代理费用的模型，为企业知识产权管理人员及经营人员、专利代理机构及代理师、发明设计人等提供借鉴。

Abstract： With the accumulation of intellectual property rights，enterprise patents have changed from the pursuit of quantity to the pursuit of quality and value.The research and development of high-quality and high-value patents has become the mainstream goal of enterprises.In other words，high-quality patents have become the basis of enterprise patent work and operation. According to the practice of patent administration， this paper analyzes and designs the model of patent's agency cost based on the number of claims， in order to provide reference for enterprise intellectual property managers and operators， patent agencies and agents， invention designers and so on.

申请人正式申请专利后将进入审查阶段：在符合“单一性”要求下，审查该专利是否具有“三性”（新颖性、创造性、实用性），是否得到说明书的充分支持。而专利的“三性”审查以其权利要求书为基础。

1 高质量专利成为企业专利管理的核心

专利申请时权利要求项数较少或主权项篇幅过长的成因有多方面，如技术领域层面、技术管理层面、沟通交流层面等。该现象表明：该专利的创新点可能相对小，与之相关的保护范围可能小;对该专利的创新点挖掘不足，缺少合理分析与布局环节;其技术方案可能比较容易规避。
