摘 要：高质量发展进程中，专利高效转化至关重要。目前我国总体上专利转化率偏低，具体而言，专利本身质量不高、应用性不强;专利转化路径较闭塞、不畅通;专利转化过程中面临多重风险。为适应高质量发展的需要，本文在立足我国国情的基础上，借鉴美国、德国等专利强国的转化经验，从提高专利本身应用性、畅通专利转化路径、促进专利与应用对接以及政府政策激励等四个方面促进我国专利高效轉化。

The Dilemma and Countermeasures of Promoting Patent Transformation

Abstract： In the process of high-quality development， efficient patent conversion is essential. At present， the patent conversion rate in my country is generally low. Specifically， the patent itself is not of high quality and not strong in applicability; the path of patent conversion is relatively blocked and not smooth; and the process of patent conversion faces multiple risks. In order to meet the needs of high quality development， we can learn from the transformation experience of powerful patent countries such as the United States and Germany on basis of my country's national conditions， from improving the applicability of patents， smoothing the path of patent transformation， promoting the docking of patents and applications， and government policy incentives. Promote the efficient transformation of patents in my country in four aspects.

2017年，中国共产党第十九次全国代表大会提出：“中国经济由高速增长阶段转向高质量发展阶段”。中国经济开始从以传统产业、传统技术为基础的经济粗放型高速发展转变为主要依靠创新驱动、实现全面协调可持续的经济高质量发展。毋庸置疑，作为创新的重要代表之一，高价值专利在新时期我国经济的高质量发展过程中发挥着举足轻重的作用。

1 专利转化及其法律依据

专利接续涌向产业发展的各个环节能够为产业的创新发展提供源源不断的动能，能够持续提高产业的生产效率，推动产业结构、产业体系的不断优化升级。缺乏专利，我国经济的高质量发展便会缺乏必要的动能，但是有了专利却无法实现转化，那么相关的专利也会被束之高阁。所以，专利被创造出来后能否转化、转化效果如何对新时期促进我国经济的高质量发展至关重要。……
