摘要：在国家治理体系和治理能力现代化的背景下，渔业发展更应注重捕捞、养殖、加工制造及销售等环节的规范化、制度化、程序化，进而加速渔业治理体系和治理能力进程。但是渔业治理体系趋于现代化的进程中存在水产养殖业、捕捞业忽视可持续发展等问题，在渔业执法过程中也存在程序瑕疵。文章针对上述问题，提出水产养殖应当合理运用生态养殖技术，相关部门严厉规制捕捞行为以促进渔业可持续发展。建立完备的渔业监管体系以促使渔业执法过程更加科学化、合理化，维护渔民合法权益，有利于我国渔业长期稳定发展。

Abstract： Under the background of“national governance system and governance capacity modern-ization”， fishery development should pay more attention to the standardization and institutionali-zation of fishing，breeding，processing，manufacturing and sales， and procedures to accelerate the process of fishery governance system and governance capacity. However， in the process of fisheries governance system modernization， there are problems such as aquaculture and fishing industry neglecting sustainable development， and there are also procedural flaws in the process of fishery law enforcement. This paper addressed the above issues， and proposed that aquaculture should reasonably use ecological aquaculture technology， and relevant departments severely crack down on illegal fishing practices to promote sustainable fishery development. It was proposed that establishing a complete fishery supervision system to promote a more scientific and rational fish-ery law enforcement process and safeguard the lgitimate rights and interests of fishermen would be conducive to the long-term and stable development of China's fisheries.

推進渔业治理体系和治理能力现代化对我国国民经济发展具有重要作用。2019年《中华人民共和国渔业法修订草案》（以下简称《渔业法修订草案》）详细规定涉及生产许可证、进出口管理等水产种质资源、养殖业、捕捞业相关问题，更加注重渔业资源增殖与保护，并且新增了监督管理一章，使得渔业治理体系更为科学、规范。然而，渔业监管过程中执法人员执法程序存在明显不合理，并且水产养殖业、捕捞业没有注重绿色、协调可持续发展，这些问题严重阻碍了渔业治理体系和治理能力现代化进程。笔者通过研究实践中阻碍渔业治理体系现代化进程的因素，提出注重养殖业、捕捞业可持续发展，完备渔业监管体系的对策建议。……
