【摘  要】经济全球化时代已经来临，随着我国经济的迅猛发展，国有企业与私营企业或海外企业的经济贸易联系日益加深。而经济合同作为双方的经济目标以及利益效果的保证，其中的条款条约都密切与双方的利益挂钩，所以对于经济合同问题，各大企业需要高度重视，采取规范有力的措施手段制定及调整经济合同，使经济合同的管理更规范、更严谨、更科学，并使其有效服务于国有企业的利益效果。论文就国有企业经济合同的管理问题与对策展开研讨。

【Abstract】The era of economic globalization has come. With the rapid development of China's economy， the economic and trade relations between state-owned enterprises and private enterprises or overseas enterprises are deepening day by day. The economic contract， as the guarantee of the economic goal and benefit effect of both sides， its terms and conditions are closely related to the interests of both parties. Therefore， enterprises need to attach great importance to the issue of economic contracts， take standardized and effective measures to formulate and adjust economic contracts， so as to make the management of economic contracts more standardized， more rigorous and more scientific， and make it effectively serve the interests of state-owned enterprises. This paper discusses the management problems and countermeasures of the economic contract of state-owned enterprises.

1 国有企业经济合同管理现状

企业的经济合同管理是企业基于自身发展情况再根据所设计的法律规定制定经济合同，同时需要注明合作双方对于经济合同所拥有的法律权力与责任，例如条款条件的履行或更改、解释权以及终止权。国有企业是我国的经济主导支柱，为我国总体GDP贡献了巨大的力量。我国国有企业在经济合同管理中存在着工作漏洞，导致了利益损失、监管不力、甚至法律纠纷等问题。无论出现以上任何一个问题对于企业来说都是一个致命的打击，使企业遭遇经济压力危机、法务缠身，最坏结果可能会濒临破产边缘。在依法治国的环境条件下，企业经济合同成为双方合作的安全保护伞，正确的管理可以关乎到整个企业发展前景的兴衰成败。试想一下，如果企……
