摘 要：近年来，知识产权侵权案件呈现多样性、复杂性特点，刑法必须发挥其优势作用。《中华人民共和国刑法修正案（十一）》对商标犯罪进行了大幅度修改，对以往存在的服务商标的争议、处罚力度不够等问题进行了回应，但也出现了法律适用上的问题，且关于反向假冒商标行为的刑民界限问题仍然存在。因此，总结现有问题主要有相同服务的认定问题、违法所得数额计算问题、其他严重情节认定问题以及刑民界限界定问题，提出明确相同服务认定标准、界定合理成本范围、量化其他严重情节以及实现反向假冒商标行为入罪等应对之策，进一步完善商标权刑事保护法律体系，以满足建设知识产权强国的需求。

Abstract：In recent years， intellectual property rights infringement cases have been characterized by diversity and complexity， and criminal law must give full play to its advantages. The "Amendment to Criminal Law of the People's Republic of China（11）" has made substantial amendments to trademark crimes and responded to the problems of service trademark disputes and insufficient penalties in the past. However， there have also been problems in the application of the law， and the problem of criminal and civilian boundaries for counterfeiting trademarks still exists. In summary， The main problems are the identification of the same service， the calculation of the amount of illegal income， the identification of other serious circumstances， and the definition of the criminal and civilian boundaries. On this basis， it puts forward the countermeasures to clarify the identification standards of the same service， define the reasonable cost range， quantify other serious circumstances， and realize the criminalization of reverse counterfeiting of trademarks to further improve the legal system for criminal protection of trademark rights to meet the needs of building a strong country with intellectual property rights.

近年來，知识产权侵权案件呈现多样性、复杂性特点，导致商标侵权问题与日俱增。2021年4月25日，《二〇二〇年中国法院知识产权保护状况》白皮书发布数据显示，2020年全国地方人民法院共新收侵犯知识产权罪一审案件5 544件，审结5 520件。审结的一审案件中，涉及商标犯罪案件共5 183件，占审结比重的94%。这一方面显示出我国知识产权司法保护取得较大成效，另一方面反映出我国知识产权侵权问题依然突出。在此背景下，如何对知识产权实现周延的保护显得尤为重要。2019年4月《商标法》第四次修改通过，同年12月《中华人民共和国刑法修正案（十一）》通过，旨在提高违法成本，强化知识产权保护。……
