摘   要： 市场经济即法治经济。我国自实行社会主义市场经济以来一直注重法治建设，尤其是十八届三中全会更是为我国市场经济嵌入了丰富的法治内核。但全国立法如何在地方实践中更好地发挥作用仍待探讨，因此调整地方立法细化相关制度，即为当下最优选择。保证企业用工之需求，增强企业用工的灵活性，降低企业用工成本等诸项内容，乃优化营商环境内涵应有之义。辽宁省在优化营商环境中，地方劳动与社会保障制度的细化方案应当增强企业用工灵活性之制度设计，通过劳动法制度的调整与适用降低用工成本，快速便捷温和的劳动争议解决方式的本土化，统一辽宁省基本养老保险用人单位缴费率，允许工伤保险费分项缴纳等等，为劳动与社会保障制度的改革和完善提供有益借鉴，探索出振兴辽宁经济的有效对策。

Abstract： Market economy is the economy governed by law. Since the implementation of the socialist market economy， China has been focusing on the construction of the rule of law. Especially the Third Plenary Session of the Eighteenth Central Committee has embedded a rich core of the rule of law in the market economy of China. However， how the national legislation can play a better role in local practice remains to be explored， so adjusting the local legislation to refine the relevant system is the best choice at present. Ensuring the demand of enterprise employment， enhancing the flexibility of enterprise employment and reducing the cost of enterprise employment are the proper meanings of optimizing the connotation of business environment. In order to optimize the business environment in Liaoning Province， the detailed scheme of the local labor and social security system should enhance the system design of flexibility of enterprise employment， reduce the cost of employment through the adjustment and application of the labor law system， localize the quick， convenient and mild way of solving labor disputes， unify the payment rate of basic pension insurance employers in Liaoning Province， and allow the payment of industrial injury insurance premiums separately， etc.. It is necessary to provide useful reference for the reform and improvement of the labor and social security system， and explore effective countermeasures for the revitalization of Liaonings economy.
