摘 要：随着世界贸易一体化进程的加快，产品外观设计新趋势引起的知识产权保护问题显得日益突出。文中从外观设计的本质和保护客体出发，探讨新常态经济条件下，外观设计发展的若干新特点及其相关的知识产权保护举措。从管理者、设计者和社会公众3方面，提出促进外观设计专利知识产权保护的建议与对策，形成合力推动设计创新，促进外观设计的新发展。关键词：外观设计；知识产权保护；设计创新中图分类号：G 306 文献标识码：A 文章编号：1672-7312（2017）06-0615-05

The Recent Advance of Appearance Design and its Intellectual

Property Protection under the New Normal Economic Conditions

Abstract：With the acceleration of the integration of world trade and the rapid development of the economy，the protection of intellectual property rights caused by the new trend of product design is becoming increasingly prominent.This paper discusses several characteristics of the latest development of appearance design and its intellectual property protection measures based on the intrinsic quality and protection object of the appearance design under the new normal economic conditions.Then，this paper proposes that the administrators，designers and the public should form resultant force to promote innovation and development together.

1 外观设计专利发展概况随着世界贸易一体化进程的加快，面对国际市场的广阔前景，国内企业意识到应当逐步将工业设计运用到企业生产的产品上，改变产品的结构和功能，开发出符合产品结构和市场需求的产品，以增强企业在市场中的竞争力，促进经济发展。知识产权保护对中国工业设计产业发展的促进作用已经日益突显，同时在世界范围内也已形成工业设计对产品附加值产生巨大提升作用的广泛共识。针对习近平总书记在2013年中央经济工作会议上提出的经济新常态战略构想，工业设计对推进中国新型工业化进程、促进经济发展方式转变必将发挥重要推动作用。外观设计虽然习惯上被称为工业品的外观设计，但被广泛应用于各种行业。绝大多数产品都涉及外观设计，又由于外观设计专利具有投入小、收效快、授权方便快捷、保护期限长等特点，机构和个人申报的积极性较高。……
