依法治体语境下的体育行业自治路径

摘要体育全球化催生了体育治理模式的改变。运用文献资料、案例分析等研究方法，对依法治体语境下我国体育行业自治问题进行探索。首先,从国际、国内视角对体育行业自治的发展情势进行阐述;其次,围绕公民社会、共同体、合法性等理论，对体育行业自治存在和发展的合理性与合法性进行论证,在此基础上对体育行业自治主体及自治权进行分析;再次,从拓展体育社团发展空间、规范体育行业自治组织制度、建设体育仲裁制度、建立运动员工会及司法干预机制等方面对体育行业自治路径进行建构。

Paths of Sports Autonomy in the Context of the Sports Governance by Law∥TAN Xiaoyong

AbstractSport globalization has led to the change of sport governance model.By using literature review and case analysis,the study explores the sport autonomy in the context of the sports governace by law.The international and domestic development of sport autonomy is first elaborated; then the rationality and legitimacy of sport autonomy is analyzed by using the theory of civil society and community theory.On this basis,the body and right of sport autonomy are discussed.Finally,the study builds the ways of sport autonomy from the development space for the sports associations,the establishment of organization system specifications,the construction of sport arbitration system,and the building of athlete unions and judicial intervention mechanism,etc.

2015年5月美国司法部官员及检察官对国际足联(FIFA)14名官员与市场营销主管提起了包括敲诈、电信诈骗、洗钱和贿赂等指控。这一“重磅炸弹”被美国司法部门引爆后,人们将目光聚焦于“美国的司法霸权”“国际足联是法外之地”“体育行业自治的监督”等问题。笔者认为,在热议国际足联腐败案时,我们更应多一些冷静的思考。一方面,国际足联在推进全球足球运动发展及商业化运作等方面功不可没,不能全盘否定全球体育组织的体制机制,国际足联等全球体育组织走自治之路的大趋势不会因此而改变。另一方面,也应认识到体育行业自治体系还存在漏洞和瑕疵,应从如何防止其发展成为“法外之地”的“独立王国”、如何从本源性上完善内部制衡和外部监督防止腐败的机制等方面进行深刻反思。……
