土地流转过程中地方政府、企业和农户之间利益的博弈分析

摘要：在中国政府推动型城镇化背景下，新农村建设是解决城镇化土地来源的主要方式，而解决欠发达地区土地流转的相关利益方的利益分享问题受到人们广泛关注。文章基于博弈理论对土地流转过程中地方政府、企业和农户之间的利益进行分析后提出：土地的产权主体是农民，政府在开发商与农户之间应该扮演“守夜人”角色，部分地方政府“看得见的手”伸得过多过长是导致政府与农民矛盾的根源。

Abstract：Under the background of urbanization pushed forward by the Chinese government, new rural construction is the main method to solve the land source of urbanization, and the problem of how to share the benefits of stakeholders in less developed areas in the process of land circulation is extensively followed. Based on the Game Theory, this paper tries to analyze the interests among local government, enterprises and farmers in the process of land circulation and proposes that land ownership is the farmers, government should play a role of “a night watchman” between developers and farmers, and too much interference from the local government is the root of the contradiction between government and farmers.

一、引言

土地流转过程中地方政府、企业(开发商)和农户之间的角色如何定位，利益如何安排，目前国内学术界和实践部门做了很多有益的探索。如蔡继明(2010)从政治经济学的视角对农村建设用地流转的主体和利益分配进行分析，认为目前我国的农村建设用地流转的主体是政府而不是农民，政府通过征地方式而不是通过市场方式购得农民土地，侵占了大部分本应农民得到的农村建设用地转变为城市国有土地的增值收益，严重损害了农民的利益。……
