摘 要：【目的】探寻新时代背景下加强民间文学艺术作品知识产权保护的路径，推动《民间文学艺术作品著作权保护条例（征求意见稿）》的出台。【方法】对辽宁省在非物质文化遗产保护模式下的创新型探索进行分析。【结果】民间文学艺术作品在当今时代下具有发展和保护并行的趋势，但在保护上仍然存在理论逻辑冲突等法律保护问题与局限性。【结论】针对保护的困境问题，分析民间文学艺术作品的自身特性，对存在问题的内在逻辑与局限性进行分析，提出明确权利主体、细化法律衔接等民间文学艺术作品知识产权保护路径。

Abstract： [Purposes] To explore the way to strengthen the intellectual property protection of folklore works in the new era， so as to promote the promulgation of the Regulations on Copyright Protection of Folklore Works （Draft for Soliciting Opinions）. [Methods] The innovative exploration of intangible cultural heritage protection mode in Liaoning Province was analyzed. [Findings] Today， folklore works have the trend of developing while  protecting， but there are still legal protection problems and limitations such as theoretical logic conflicts in their protection. [Conclusions] Aiming at the dilemma of protection， the research analyzes the characteristics of folklore works， unfolds and locates the internal logic and limitations of the problems， and obtains the intellectual property protection path of folklore works， such as clarifying the subject of rights and refining the legal connection.

0 引言

当前，我国正在从知识产权引进大国向知识产权创造大国转变，知识产权工作从追求数量向提高质量转变。《知识产权强国建设纲要（2021—2035年）》明确提出建设面向社会主义现代化的知识产权制度，其中重点强调了加强遗传资源、传统知识和民间文艺等获取和惠益分享制度建设，加强非物质文化遗产（简称“非遗”）的搜集整理和转化利用。要构建全方位、多层次的知识产权保护格局，在推动非遗创造性发展的同时，保护其知识产权成为建设重点。

“非遗+”模式将非遗与其他領域结合，充分利用不同领域的资源以期对非遗起到发展和传承的作用，是辽宁省在国家政策方向下创造出的新模式。辽宁省内非遗资源丰富，目前已经探索出“非遗+文创”“非遗+剧场”“非遗+舞台”等形式，宣传效果显著，在全国独树一帜［1］。……
