摘要：环境影响评价与排污许可制度作为环境保护管理活动的关键手段，对我国生态文明体制的建设都发挥着重要作用。在生态文明的新时代背景下，对于两项制度在环境管理体系的地位，要正确认识、理性分析二者之间的法律关系及地位，从两个制度之间的法律关系和地位出发，寻求两者之间的效益最优化，环境影响评价与排污许可制度之间不是相互削弱或者替代的关系。而以排污许可制度为可信的主导地位，简化环境影响评价成为当前生态文明体制改革的潮流趋势，使得它们在我国环境管理中发挥重要作用。

Absrtact：Environmental impact assessment and of environmental protection and management，environmental impact assessment and sewage permit system play an important role in the construction of ecological civilization system in China.Under the background of the new era of ecological civilization，we should correctly understand and rationally analyze the legal relationship and status of the two systems in the environmental management system，and seek the benefit optimization between the two systems from the legal relationship and status between the two systems.The relationship between environmental impact assessment and emission permit system is not mutually weakened or replaced.The simplified environmental impact assessment has become the trend of the current ecological civilization system reform，which makes them play an important role in the environmental management of our country.

環境影响评价是指对环境和自然资源开发利用的规划、建设项目的决策实施前，可能发生的对环境造成影响的进行的一系列事前分析、预测和评估，并提出相应的对策措施以减轻不利影响，然后对其跟踪监测的方法和规则体系。排污许可证制度是建设或经营单位按照污染源向政府部门提出申请，经审核符合规定，允许排污的一项活动制度，该制度的授予广受欢迎，一般来说，政府批准的行政许可就是排污许可证。2020年3月下发的《关于构建现代环境治理体系的指导意见》中提出的要“妥善处理排污许可证制度与环评制度的关系”被作为企业环境治理责任制的一项重要任务。当前，《环境影响评价法》修订工作在进行时，《排污许可管理条例（草案）》于2020年12月通过。……
