摘 要：迈克尔·桑德尔对约翰·罗尔斯的契约论的批判主要集中在质疑契约的道德力量、指出罗尔斯对原初状态的经验主义解读存在的缺陷和反驳契约主义的论证方式。实际上，上述批判难以令人信服：第一，契约论内部不存在桑德尔所谓的张力，即使这种张力存在，人们也可以用罗尔斯的“词典式序列”观念进行化解;第二，对原初状态的经验主义解读误解了罗尔斯的原初状态观念;第三，桑德尔从任何契约都应当是讨价还价的结果这一立场出发质疑罗尔斯的契约论，错置了批判的对象，只能将矛头指向“互利契约论”传统。

On Sandels Three Misunderstandings of Rawlss Contract Theory

Abstract： Michael Sandels criticism of John Rawlss contract theory mainly focuses on questioning the moral power of contract， pointing out the defects of Rawlss empirical interpretation of the original position and the way to refute contractualism. In fact， the above criticism is unconvincing： First， there is no tension in contract theory， and even if this tension exists， people can use Rawlss concept of “dictionary sequence” to resolve it; Secondly， the empirical interpretation of the original position misunderstands Rawlss concept of the original position; Thirdly， Sandel questions Rawlss contract theory from the standpoint that any contract should be the result of bargaining in that it misplaces the object of criticism and only points the finger at the tradition of “mutually beneficial contract theory”.

自20世紀70年代以来，在约翰·罗尔斯等人的努力下，政治哲学开始了复兴。作为当代政治哲学的主要推动者，罗尔斯于1971年发表的《正义论》引起了巨大的争议，譬如，在此后的10年间，罗纳德·德沃金和罗伯特·诺齐克等人分别从自由主义的左翼和右翼出发批判了罗尔斯的新自由主义理论，到了20世纪80年代，迈克尔·桑德尔、阿拉斯戴尔·麦金太尔、查尔斯·泰勒和迈克尔·沃尔泽等人从“共同体”的立场出发，对以罗尔斯为代表的新自由主义理论展开了猛烈的批判，他们的理论被统称为“共同体主义”（communitarianism），这也使得自由主义与共同体主义之间的争论成为一个备受关注的热门话题。目前随着共同体的价值日益受到重视，自由主义与共同体主义之间的争论有一种复兴之势，我们有必要重新审视自由主义与共同体主义之争。……
