摘 要：非物质文化遗产是世界文化中的一项宝贵的财富，对每个国家和民族来说都至关重要。河南省作为历史悠久的文化大省，蕴育了许多非物质文化遗产。因此，介绍我国非物质文化遗产的现状，结合我国国情，分析目前我国对非物质文化遗产的保护，再从实际出发分析具体情况，提出对中原非物质文化遗产保护的建议，并结合知识产权制度对河南省非物质文化遗产进行直接和间接保护，以帮助中原地区弘扬传统文化，促进我国文化的发展。

Central Plains Intangible Cultural Heritage Protection under

the Background of Intellectual Property Rights

Abstract： Intangible cultural heritage is a precious treasure in the world culture， which is of great importance to every country and nation. Henan， as a large province with a long history of culture， has nurtured a lot of intangible cultural heritage. This article first introduced the present situation of the intangible cultural heritage in our country， and combining with China's national conditions， analysis of the current Chinese legal protection of intangible cultural heritage， then embarks from the reality， the specific situation of the analysis， put forward the suggestions to the central plains of culture heritage protection， combining with the knowledge property right system of henan province non-material cultural heritage protection of direct and indirect. It is conducive to helping the Central Plains carry forward traditional culture and promote the development of Chinese culture.

1 非物質文化遗产的特点

1.1 非物质文化遗产的概念

非物质文化遗产包括不同群体、团体[1]和受个人观念影响较大的文化遗产。非物质文化遗产现有以下6种形式：①传统口头文学以及作为其载体的语言;②传统美术、书法、舞蹈、戏剧以及杂技等，如河南滑县的秦氏绢艺;③传统技艺、医药处方和历法;④传统礼仪、节庆等其他民间习俗;⑤传统体育运动和游艺;⑥其他非物质文化遗产[2]。

1.2 非物质文化遗产的特点

1.2.1 非物质性。物质文化遗产和非物质文化遗产的最重要区别在于非物质文化遗产是无形的[3]。河南省安阳市的红旗渠作为物质文化遗产的一种，代表了所有物质遗产的特性。非物质文化遗产不以物质为表现形式[4]，而是以人类为媒介，通过声音和影像等表现形式，将这些没有实体的技艺延续下去，因此非物质文化遗产不是有形的物质。……
