摘要：互联网技术对国民经济和农村经济产生了深刻影响，通过运用互联网大数据的分析能力，推动了农村一二三产业的融合，促进农村经济转型升级。农产品质量安全问题频发的状况，也暴露出现阶段农产品质量安全法律的不完善。因此，在解释相关法律概念、分析相关法律缺陷的前提下，提出适合“互联网+农业”背景下的农产品质量安全法律规制路径的建议。

Abstract：Internet technology has had a profound impact on the national economy and the rural economy. Through the use of the analysis ability of Internet big data， it has promoted the integration of the primary， secondary and tertiary industries in rural areas and promoted the transformation and upgrading of the rural economy. The frequent occurrence of agricultural product quality and safety problems also exposes the imperfections of agricultural product quality and safety laws. Therefore， on the premise of explaining the relevant legal concepts and analyzing the relevant legal defects， this paper proposed the legal regulation path of agricultural product quality and safety in the context of “Internet + agriculture”.

2015年政府工作报告首次提出“互联网+”，颁布了《国务院关于积极推动“互联网+”行动的指导意见》。互联网利用其巨大优势，对农业经济进行整合、改造及升级，已经成为推动中国经济快速发展的力量之一[1]。“互联网+农业”促进了农业产业链的延伸，为农民生产和管理提供了新的方式，推动农村经济转型升级，并催生出了一种新的行业模式和商业模式。然而，农产品质量安全问题频发，也折射出国家农产品质量安全问题。

2019年初农业农村部等7部门共同出台的《国家质量兴农战略规划》提出，要推进农业高质量发展，到2022年，要基本建立质量兴农制度框架，这对农产品质量安全提出了更高的要求。《中国食品安全发展报告（2018）》分析认为，2014―2017年主要食用农产品质量检测的合格率仍然保持高位数，并且有小幅提升，基本处于96%，当前食用农产品的质量安全问题还比较突出，并且对该问题的监督管理时间漫长，治理困难。……
