摘 要 本文从《跨太平洋伙伴关系协议》（TPP）生物制品数据保护条款出发，在剖析条款要点与制度效应基础上，根据产业发展水平探究我国生物制品数据保护政策定位问题。研究发现，现阶段我国创新投入水平和居民支付能力与生物制品数据保护制度并不匹配，实施该制度的负效应将大正效应。建议我国在完善产业配套制度、促进产业转型升级的同时，审时度势，谨慎分析利弊，并设计相应谈判策略预案。

Data protection provisions for biologics in TPP and policy orientation in China*

ABSTRACT This paper proceeds from the data protection provisions of Trans-Pacific Partnership Agreement （TPP）. The essential principles and the underlying policy influence of the provisions and the policy orientation of data protection provisions for biologics in China were discussed. Research results indicated that the R&D investment and healthcare affordability in China failed to match the establishment of biologics data protection system. The system will be more detrimental than beneficial if established without careful consideration. Therefore， China should improve the industry supporting system， promote industry transformation and upgrading， and then analyze advantages and disadvantages. Meanwhile， the negotiation plan of data protection for biologics must be designed in advance.

生物制品数据保护是由欧美发达国家率先建立的知识产权保护制度。2008年，美国积极主导《跨太平洋伙伴关系协议》（Trans-Pacific Partnership Agreement，TPP）谈判，由其主张的最重要领域之一便是生物制品数据保护条款，同时也是各谈判成员国争议最大的问题之一。作为亚太地区重要的发展中国家，中国虽尚未加入TPP谈判，但随着经济全球化的不断加深，TPP高知识产权保护标准势必会影响到中国的对外贸易。同时中国在对外谈判中已经受到来自欧美国家要求生物制品数据保护的压力（如中美商贸联合会JCCT会议等）。因此是否需要建立生物制品数据保护制度，已成为现阶段中国亟需解决的问题。

本文首先对TPP生物制品数据保护条款内容进行简要介绍，并重点分析该条款将带来的社会经济效应，最后结合中国生物制药产业发展现状，提出中国生物制品数据保护政策定位，以及对外谈判中的立场选择。……
