围绕《促进科技成果转化法》探究科技成果转化的法律依据与实施障碍

【摘要】科技成果的有效转化是推动社会发展，提升生产力水平的关键之举。改革开放以来，我国科研技术能力日益提升，科技成果转化机制逐步完善。随着《促进科技成果转化法》的颁布实施，我国国内科技成果转化有了更为直接的法律依据，为科技成果转化提供了必要保障。但在实际的科技成果转化过程中，依然存在法律制度不完善，法律实施存在障碍等实际问题。

The effective transformation of scientific and technological achievements is the key to promote social development and improve the level of productivity. Since the reform and opening up，China's scientific and technological ability has been increasing，the mechanism of scientific and technological achievements have been gradually improved. With the promulgation and implementation of“promoting the transformation of scientific and technological achievements”，the transformation of scientific and technological achievements in China has a more direct legal basis，which provides a necessary guarantee for the transformation of scientific and technological achievements. But in the actual process of the transformation of scientific and technological achievements，there are still legal system is not perfect，there are obstacles to the implementation of laws and other practical problems.

科技成果转化是为提高生产力水平而对科学研究与技术开发所产生的具有实用价值的科技成果所进行的后续试验、开发、应用、推广直至形成新产品、新工艺、新材料，发展新产业等的活动。科技成果转化是否能够达到预期效果，需要外部环境的保障。科技成果转化所依赖的法律体系是否健全，法律实施是否有效直接关乎到科技成果转化的实际效果，同时也影响着科学创新的效率和效能。我国《促进科技成果转化法》的颁布实施，标志着我国科技成果转化步入一个新的时期。

1　科技成果转化的价值意义分析

科技是第一生产力，随着科技创新进程的加快，有效实现科技成果转化成为一个突出的现实课题。科技成果转化价值意义体现在两方面：

其一是科技成果转化具有社会价值。通过有效的科技创新和科技成果转化，公众能够获取到更为丰富的社会资源，使公共服务和管理的效能得到持续提升。……
