摘 要：在国内外相关研究资料的基础上，结合制度变迁理论，对新型土地股份合作制的研究背景、基本内涵、主要模式以及全国各地土地股份合作制实施绩效的相关理论与实证研究进行探讨和分析并加以整理。发现新型土地股份合作制在运行过程中的创新与不足，针对不足提出意见与建议，讨论我国新型土地股份合作制的未来发展方向与前景。

Review of Research Progress of the New Joint-stock Cooperative System of Rural Land

Abstract： On the basis of relevant research data at home and abroad， combine the theory of institutional change， and discuss the background， basic connotation and main mode as well as the implementation performance across the country of the New Joint-stock Cooperative System of Rural Land with related theory and discusses the empirical research and analysis and arrange them. Find the innovation and deficiency in the process of operation， and put forward opinions and suggestions， and discuss its future development direction and prospect.

1 研究背景

随着我国城乡差距的进一步拉大，20世纪80年代末，家庭联产承包责任制与社会化生产、市场经济的要求等经济基础产生了诸多矛盾，广东部分改革前沿地区表现尤其明显，然而土地私有化或者国有化均不适合我国现实国情，必须要找到新的形式来实现农村土地集体所有制。土地股份合作制绕过所有制，通过改善经营方式，回避了农村土地集体所有制的权属关系缺陷，这只是延缓和积累产权不清的矛盾，不能从根本上克服现有产权制度的缺陷，但是它是所有土地制度创新中最具有创新意义的。在农村土地集体所有制的基础上比较好地明晰了集体产权，既在某种程度上满足了农民拥有土地所有权的愿望，让土地起到了保障功能，又降低了政府面临的土地制度创新的政治风险[1]。
