摘 要：如何规范建筑工程合同管理，确保工程按合同规定的内容保质、保量、按期完成工程建设，减少工程变更和索赔，合理有效地控制投资，是保证建筑工程项目取得最大经济收益的关键。本文针对建筑工程造价控制如何规范合同管理的措施进行了分析，包括：规范处理合同中施工条件等的改变和施工方案的改变；规范工程变更和索赔等。

建筑工程施工合同管理是施工企业项目管理的中心工作之一，是保证建筑工程项目取得最大经济收益的关键[1]。但目前我国建筑工程施工的相关合同管理仍存在众多问题，如下所示：

1 我国建筑工程施工合同管理现状及存在的问题

1.1 建筑企业合同法律意识淡薄

许多建筑企业经营运作不规范，法律意识不强，缺乏合同意识。国家工商局和建设部虽然制定了《建筑工程施工合同示范文本》，但有些建筑企业在签署合同时不依据此合同文本，内容不全，对权责和义务的规定不明确'导致签署的合同流于形式。2014年，北京市建委抽查在建房屋建筑和市政基础设施工程施工现场109个，发现有72%的合同不规范，一旦这些工程发生纠纷，建筑企业必将承担许多隐形的风险和损失。

1.2 承、发包双方的行为不规范

建筑工程的承包人有时为了业务需要，会超越本企业资质等级签订合同[2]。例如，有些承包商在自身不具备项目施工资质的情况下，为达到承包工程的目的，非法向发包人行贿或者假借其他有承包资质企业的名义进行虚假投标。……
