摘要：欧洲体育运动在国际奥林匹克运动中占据着非常重要的地位，其体育争议解决机制也对其他体育运动争议的解决有一定的参考价值。解决欧洲体育运动争议的组织包括政府和非政府的体育组织，解决方法主要有仲裁、调解和诉讼等。在一定程度上法院可以介入体育争议，但需要考虑纯粹性体育运动争议的可审查问题以及仲裁不干涉的原则。

Abstract:European sport plays a very important role in the international Olympic arena, its sports-related disputes resolution system also has a model influence to others. The organizations that can deal with sports disputes are governmental organizations and non-governmental sports federations, and the solution of these disputes includes arbitration, mediation and litigation. The national court can intervene sports disputes to a certain degree, but it should take into account of the possibility of the examination of the purely sports disputes and the principle of non-arbitrability of similar disputes.

体育运动虽然涉及政治问题，但更多的是显示一种社会或者文化的功能。欧盟只能说是欧洲若干国家的政治联盟，其成员只是包括欧洲版图的若干国家。而就自认为民间性质的体育组织来讲，例如欧洲足联、欧洲奥委会等，其会员就几乎涵盖所有的地理意义上的欧洲国家，甚至某些近邻的亚洲国家的体育协会也自愿加入欧洲的体育组织。还有就是，考虑到政治上的原因，有些国家一直没有加入欧盟，例如俄罗斯，但是其在世界体坛的地位确实不容低估甚至是不可或缺的。因此，作者是想从一种更广的角度来研究欧洲体育争议的解决机制，毕竟体育运动带给我们的首先是其民间性质，其次才能谈到娱乐或者政治功能，虽然后两者的作用越来越加强。

鉴于体育运动的商业化氛围越来越浓，当事人从事体育运动的目的不再是仅仅限于强身健体或者娱乐，而更多的是把从事体育比赛当作是一种职业或者是谋生的手段。……
