Discussion on the Legal Nature of ICAO Navigation Standards and the Enhancement ofBeiDou System's Influence

Abstract：TheinclusionofBeiDouSARPs intheVolumeIofAnnex10oftheConventiononInternationalCivilAviationis undoubtedlyamajorbreakthrough inthe internationalizationofBeiDoucivilaviation standards，whichmarks thatBeiDou systemhasoffciallybecomeaglobalsatelitenavigationsystemrecognizedbytheICAO.Thestableoperationofthesystem cannotbeseparated fromtheperfectstandardsdevelopment，andtheresearchonICAOnavigationstandards includingBeiDou SARPs is the prerequisite foundation for the subsequent development of BeiDou system.This paper introduces the main contentsofICAOnavigationstandardssuchas thedevelopmentbodytheformofperformance，asellasthedevelopentnd revisionproces.Throughanalysisanddemonstration，itisconcludedthatalthoughSARPsshouldberegardedasinteational softlawintermsofthelegalnature，theactualimplementationcanalsohavecertainlegalefects.Inthefuture，Chinahould improve thedomestic standardssystemofBeiDou civil aviationapplication as soonas possible，continueto promote the standardization workof BeiDou SARPsin ICAO，andcontinuously enhance the international incluenceofBeiDousystemin standardsdevelopment，soas torealizetheglobalandindustrialapplicationofBeiDousystemincivilaviation field.

北斗卫星导航系统是我国首个独立研发、自主运行的全球卫星导航系统（GNSS）。随着北斗三号建成，北斗系统已在我国民航领域广泛应用。系统的稳定运行离不开完善的标准制定。北斗系统在民航领域的全球化、产业化应用，必须得到国际民航组织（ICAO）的认可，并将其系统标准加入ICAO规范体系。为此，中国民航局于2010年向ICAO提交了制定北斗标准和建议措施（SARPs）的申请并于2011年获批。在经历了十多年的努力探索和标准验证后，包含北斗SARPs的《国际民用航空公约》（以下简称《公约》）附件10卷I第93次修订于2023年11月正式生效，这标志着北斗系统正式成为ICAO认可的GNSS核心星座。不可否认的是，加入ICAO规范无疑是北斗民航标准国际化工作取得的一大突破，但我国面临的挑战依然严峻。未来，如何继续推进北斗民航标准在ICAO中的国际化工作，如何提升我国在导航标准制定上的国际话语权，实现北斗系统在民航领域的全球化、产业化应用仍是北斗工作组面临的现实问题。目前，北斗标准在ICAO规范中主要以SARPs及其指导材料的形式存在，具体规定在《公约》的附件10卷I当中。准确把握ICAO导航标准的法律性质是北斗系统在民航领域全球化、产业化应用的前提基础，也是提升我国导航标准制定国际话语权的必然要求。

1 ICAO导航标准的制定主体

ICAO导航标准的制定，由国际民航组织及其内设机构与有关的《公约》缔约国共同进行。
