摘？要：诚信档案是资本市场良性运行的保障，国家先后颁布多项法律法规强化资本市场信用制度体系建设，然而近年来，资本市场失信行为有增无减，信用伦理危机日渐加重。通过相关政策性文件的梳理，分析资本市场诚信档案信息来源与范围及其利用方式，可以看出，现阶段资本市场诚信档案信用价值未得到应有的重视，诚信信息利用意识较弱。基于“善”的伦理视角，从诚信档案管理与数据治理两个层面，树立诚信档案善治观，激发多元治理模式，完善诚信档案数据共治策略，以化解资本市场信用伦理危机。

Good Management and Good Governance： The View to Explore Credit Value of Integrity Archives in the Capital Market

Although there are a number of laws and regulations have been promulgated in order to strength the credit system， break promises is growing and the credit ethical crisis of capital market is aggravated gradually. This paper emphasis on analyzing integrity archives information sources， contents and its use of capital market by the way of teasing relevant policy documents， which shows the credit archival value of capital did not get the attention and its using consciousness is weak. Under the ethical perspective of Good， which concluding sets up the concept of good governance， inspire multiple governance model， build credit archives data management solutions， to dissolve the credit ethical crisis of capital market from integrity archives management and data governance level.

2008年资本市场第一个统一的“诚信档案”正式运行；2012年，证监会建成“资本市场诚信档案数据库”，之后不断扩充诚信档案覆盖的主体和内容范围，拓展数据库功能应用；2020年3月，证监会修订《证券期货市场诚信监督管理办法》（以下简称《管理办法》），进一步明确资本市场诚信建设和监管相关事项。截至2020年末，诚信档案数据库共收录主体信息100.95万余条，涵盖行政许可信息、监管执法信息、部际共享信息等。[1]诚信档案数据库与查询平台建设使得跨部门间的信息共享得以实现。然而，2020年以来，证监会仍查出操纵市场案件90起、内幕交易160起；做出操纵市场、内幕交易案件行政处罚176件，罚没金额累计超过50亿元；向公安机关移送涉嫌操纵市场犯罪案件线索41起、内幕交易123起，移送犯罪嫌疑人330名。……
